Terms of Service

1. Acceptance and eligibility

These terms govern your use of the Tiders website and the Tiders application (the "Service"), which is operated by its founder from Chile and offered worldwide. By creating an account or using the Service you accept these terms. You must be at least 18 years old and able to form a binding contract to use the Service.

2. What Tiders is

Tiders is an informational and educational platform for traders: a market activity scanner, a rules-based signal reader, a backtester, a trade journal, and analytics derived from your own journal. Tiders is not a broker-dealer and not an investment adviser; it does not execute trades, hold funds, or provide investment advice. See the Risk Disclaimer, which is part of these terms.

3. Your account

You are responsible for your account and for keeping your sign-in method secure. Provide accurate information and tell us promptly at hello@tiders.ai if you believe your account is compromised.

4. Beta service

Tiders is currently offered as a free private beta. Features may change, be added, or be removed without notice, and availability is not guaranteed. If paid plans are introduced later, pricing and billing terms will be presented before you are ever charged. You can stop using the Service at any time, and the application includes built-in account export and deletion.

5. Acceptable use

• Do not attempt to breach, probe, or overload the Service.
• Do not scrape, resell, or redistribute the Service or its data.
• Do not use the Service to violate any law or third-party right.
• Do not misrepresent Tiders output as advice from Tiders when sharing it.

6. Your content

Your journal entries, notes, and watchlist remain yours. You grant us the limited license needed to store and process them in order to operate the Service. We do not sell your content.

7. Market data and third-party services

The Service displays market data obtained from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of any market data or of any output derived from it. Market data is provided for your own personal use within the Service. You may not extract, redistribute, resell, or republish it, or anything derived from it, and your right to see it ends when your access to the Service ends.

8. Intellectual property

The Service, including its software, design, and content (excluding your content), is owned by Tiders and protected by intellectual property laws. These terms grant you a personal, non-transferable right to use the Service; they transfer no ownership.

9. No investment advice

All information in the Service is provided for informational and educational purposes only and is not investment advice. You are solely responsible for your trading decisions. The Risk Disclaimer applies to all use of the Service.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOST DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (OR USD 100 IF YOU HAVE PAID NOTHING).

12. Indemnification

You agree to indemnify Tiders against claims arising from your violation of these terms or misuse of the Service.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these terms or harm the Service, and may discontinue the beta with reasonable notice.

14. Changes to these terms

We may update these terms as the Service evolves. Material changes will be announced on this page with a new "last updated" date; continued use after changes means acceptance.

15. Assignment

You may not transfer your rights under these terms. We may transfer ours to a successor that takes over the operation of the Service, including a company formed to operate it, provided that successor is bound by these terms and by the Privacy Policy.

16. If part of these terms does not hold

If any provision of these terms is found unenforceable, the rest stays in force and that provision applies to the fullest extent the law allows. Not enforcing a provision on one occasion does not waive it. These terms, together with the Privacy Policy and the Risk Disclaimer, are the entire agreement between you and us about the Service.
